在我国船员外派劳务运作方式下，外派船员与外籍船东之间不直接签订合同，而是通过船员与外派机构之间、外派机构与外籍船东之间签订的两个合同来实现。在司法实践中存在船员外派劳务纠纷中责任主体很难确定，外派船员权利保护立法薄弱等问题。因此，有必要通过对船员外派实务中涉及的三种合同性质的辨析，进一步厘清船员外派中各种合同法律关系，分析船员外派劳务纠纷及外派船员人身伤亡损害赔偿纠纷中涉及的重要法律问题，并提出保护我国外派船员权利的法律建议。

According to the legislation in China, Chinese seafarers cannot sign the contracts with foreign ship-owners directly and the dispatching of services could only be achieved through qualified dispatching agencies. In the current judicial practice, it is difficult to ascertain the responsible party in the labor disputes in seafarers dispatching and the legislation regarding the protection of rights of seafarers is quite weak. Through analyzing the nature of the contracts involved in the dispatching practice the legal relationships between the different parties have been clarified. By studying the legal issues arising from disputes of labor and the compensation from personal injuries, the relevant legal advice concerning the protection of rights on seafarers dispatched has been proposed.
