我国现行的集体土地增值收益归国家所有的制度,严重损害了农民的土地利益。现行征地制度和各级政府对土地利益的追逐,影响农民土地增值收益权的实现。想真正实现农民的土地权利,就必须建构农民和国家分享土地增值收益权的利益共享机制,实现对集体土地增值收益权的重构。重构集体土地增值收益权,对缓解人地冲突、完善农民的社会保障权及促进理性政府的形成具有重的理论价值和现实意义。
我國現行的集體土地增值收益歸國傢所有的製度,嚴重損害瞭農民的土地利益。現行徵地製度和各級政府對土地利益的追逐,影響農民土地增值收益權的實現。想真正實現農民的土地權利,就必鬚建構農民和國傢分享土地增值收益權的利益共享機製,實現對集體土地增值收益權的重構。重構集體土地增值收益權,對緩解人地遲突、完善農民的社會保障權及促進理性政府的形成具有重的理論價值和現實意義。
아국현행적집체토지증치수익귀국가소유적제도,엄중손해료농민적토지이익。현행정지제도화각급정부대토지이익적추축,영향농민토지증치수익권적실현。상진정실현농민적토지권리,취필수건구농민화국가분향토지증치수익권적이익공향궤제,실현대집체토지증치수익권적중구。중구집체토지증치수익권,대완해인지충돌、완선농민적사회보장권급촉진이성정부적형성구유중적이론개치화현실의의。
The current collective land value-added profit shall be owned by the state of the system,which seriously harms the land-interests of farmers. Pursuit of the land-interests from the current land expropriation system and the governments at all levels has impacts the realization of farmers＇ land value-added profit. To achieve the land rights of farmers, it has to construct farmers and countries to share the land value-added income right of benefit sharing mechanism, to appreciate the reconstruction of collective land value-added profit. Reconstruction of collective land value-added profit, can alleviate human conflict, improve the social security right of farmers and promote has important theoretical value and practical significance to form the rational government.
