在我国当前土地的稀缺、地价的飙升、耕地保护红线的背景下,向大海要地成为时尚.民间资本填海造地与政府填海造地有根本的不同,其产生的法律问题较多,其中最大的问题是“海变地”过程中的权证转化问题.既然有法律允许甚至鼓励民间资本参与填海造地,就应当保障其权益,考虑其创造的增值价值,并在专门的填海造地法律中有所体现.
在我國噹前土地的稀缺、地價的飆升、耕地保護紅線的揹景下,嚮大海要地成為時尚.民間資本填海造地與政府填海造地有根本的不同,其產生的法律問題較多,其中最大的問題是“海變地”過程中的權證轉化問題.既然有法律允許甚至鼓勵民間資本參與填海造地,就應噹保障其權益,攷慮其創造的增值價值,併在專門的填海造地法律中有所體現.

Land reclamation is fashionable under the background of land scarcity, land prices soaring and the red line of arable land protection. It is quite different between private capital and government capital Involving in land reclamation. The former will produce many legal problems among which the most important one is the sea area use right converting into land use right. Since the laws allow and encourage private capital participate in land reclamation, they shall protect the investors interests, consider their value creation in the process of land reclamation, and all of these shall be confirmed in law.
