原始佛教法是由佛陀所制定并且为世俗法所承认的,原始佛教规范具备法律要素,既有内部立法权,也得到了世俗统治者的承认,是“未完备世界”的法律,而中国佛教法的效力渊源来自于两部分,一是佛教内部立法权的确立,此为佛教法立法权的继承,主要是“适宜”规则的运用。二是世俗政权的承认。
原始彿教法是由彿陀所製定併且為世俗法所承認的,原始彿教規範具備法律要素,既有內部立法權,也得到瞭世俗統治者的承認,是“未完備世界”的法律,而中國彿教法的效力淵源來自于兩部分,一是彿教內部立法權的確立,此為彿教法立法權的繼承,主要是“適宜”規則的運用。二是世俗政權的承認。
원시불교법시유불타소제정병차위세속법소승인적,원시불교규범구비법률요소,기유내부입법권,야득도료세속통치자적승인,시“미완비세계”적법률,이중국불교법적효력연원래자우량부분,일시불교내부입법권적학립,차위불교법입법권적계승,주요시“괄의”규칙적운용。이시세속정권적승인。
The primitive Buddhist law is formulated by the Buddha and acknowledged by the state . The codes of primitive Buddhism have the legal elements which have internal power of legislation and are acknowledged by the state and they are laws of the incomplete world .The power of Chinese Buddhist law originates from two parts :one is the establishment of the internal legislative power which inherits from the primitive Buddhist law ,especially the application of the principle of "being suitable" formulated by the Buddha ,and the other is acknowledged by the state .
