改革开放以来，社会治理体系的法制化已经成为一个明显的发展趋势，法律在社会治理中起到越来越大的作用。但是，法制化是需要成本的，不仅需要完备的法律，更重要的是法律的实施，法制化的运作需要有合格的法律工作者，也需要有国家和个人对法律事务更多的支出。法制化提高了社会治理的效率，但是随着越来越多的诉讼涌向法院，法院不堪重负，原有的人民调解被弱化。由于司法腐败、执行难等因素的影响，司法公信力受到挑战。我国社会治理体系的建设应该勇敢面对问题，总结经验和教训，要充分发挥法律在社会治理体系中的作用，把党的领导，政府主导、调动一切社会因素有机地结合在一起，走一条符合中国国情的社会治理创新之路。

Since the reform and opening up, law has played more and more important role in governing society, so that legalization of social governance has already become an obvious tendency in China. However, the legalization needs a cost, not only including complete laws, but also cost in law-enforcing. The legalization of social governance is premised on the qualified legal workers as well as more investment on the legal affairs by government and individuals. No doubt that the legalization increases the efficiency of social governance, however, along with more and more cases rush into courts so that courts can＇t bear so much caseload, the original way to regulate disputes, the people＇s mediation becomes weaken. Because of judicial corruption, difficult enforcement and etc., the judicial credibility of courts is seriously challenged. The construction of social governance system in China should bravely face the issue and sum up the experience and lessons. Even so, the role of law in social governance should be fully played, in which three factors, namely, leadership of the CCP, leading role of the government, and playing role of every social positive factors in governing society, should be organically integrated in order to find an innovative way of social governance.
