所谓旅游市场的“柠檬问题”是指市场交易中各方对产品或服务的质量信息不对称,卖方利用其信息的优势在利益的驱动下以次充好,把高质量产品或服务挤出市场的逆向选择过程,进而出现产品或服务质量普遍下降,市场紊乱甚至市场失灵的现象。随着我国旅游业的持续快速发展,旅游市场中的“柠檬问题”日渐突出。如何有效地规避这一问题,论文通过分析我国旅游市场“柠檬问题”的产生机制、表现、危害等方面,提出要解决我国旅游市场“柠檬问题”,必须有效实施《旅游法》,维护旅游者合法权益;完善旅游合同立法,规范旅游市场秩序;加强监督管理,促进我国旅游业良性发展。

The problem of Lemon in tourism market refers to the phenomenon that asymmetric infor- mation about products or service quality among participants in transaction, and sellers driven by the profits tend to pour out their low-qualified goods while they still squeeze out the high-qualified prod- ucts and service by means of their advantageous information. Therefore, the result is generally low qualitied products and service as well as the disordered and mal-functional market. The problem of Lemon becomes more and more obvious in tourism with the advancement of tourism. How to effectively avoid the trouble? The paper proposes that there is a need to implement the Tourism Law forcefully, protecting tourists' legal benefits and rights, improving the contract of tourism laws, standardizing tourism system, strengthening supervision and management, promoting tourism' s well development in order to handle the problem of Lemon successfully through the analyses of reasons, representations and harms of the problem of Lemon in market.
