数字遗产是一种新型财产，有着明显不同于其他遗产的特征。数字遗产所具有的物的属性、财产属性以及遗产的属性要求数字遗产继承的实现。但是数字遗产的继承面临着法律和现实的双重困境：在法律层面，物权法对数字财产的认定缺位，继承法无数字遗产继承的相关规定；在现实层面，存在继承所涉主体多元权利义务关系复杂、继承客体多样保护范围难以准确界定、行业利益冲突难以有效协调等问题。因此，通过修改继承立法，或者发布司法解释，或者发布指导案例的方式等是实现数字遗产继承的有效路径选择。

As a new type of property,digital heritage has characteristics significantly different from other properties. Possessing the attributes of matter, property, and heritage, digital heritage requires the reali zation of inheritance. However, digital inheritance now is facing with the dual dilemma of law and reality. On the legal level, there are deficiencies in the property law to give definable affirmation to digital herit age;and in reality,the relationship between multiple rights and obligations relating to inheritance subject is complicated,and the various scopes of protection relating to inheritance object are hard to define,and the conflicts of interest in different trades are also hard to coordinate. So, revising inheritance Iaw,or is suing judicial interpretation, or issuing cases as guideline should be the specific ways to realize digital in heritance.
