法律不只是书本上的规则体系，它还通过司法产生效果，影响人们的实际生活。离婚法的诉讼实践不只是裁判离婚标准及其具体情形的应用，它还使婚姻期间“沉睡”的夫妻财产制规则得以“苏醒”，并发挥作用；在此过程中，离婚救济措施也接受着是否符合离婚法公平正义理念的实践检验。2001年我国《婚姻法》修正以来，例示性法定离婚理由、离婚共同财产分割原则、离婚救济措施等规定在离婚诉讼实务中应用如何，是检验其妥当性的重要视角。民法典体系下，完善我国离婚立法，应继续贯彻“保障离婚自由，防止轻率离婚”的宗旨，除关注与诉讼离婚相关的法律制度完善外，还要关注协议离婚制度设计与这一宗旨的协调统一。

Law is not just a system of rules on the books, it is also generated by judicial effectiveness, and impacts people＇s real life. Litigation practice of divorce law is not just the applications of legal criteria and grounds for divorce, but also to make the rules of matrimonial property system ＂wake up＂ and to play its role ; during the process, divorce relief also accept a practice test whether it fits the fairness and justice of divorce law or not. The applications of exemplary legal grounds for divorce, principles of joint property division on divorce, divorce remedies and so on are the important perspective to test the validity of the revision of Chinese Marriage Law in 2001. Under the Chinese Civil Code system, improving divorce law should continue to implement the legislative purpose of ＂protection of freedom of divorce, prevention of frivolous divorce＂ , not only the legal systems related to divorce proceedings in a court of law, but also agreement divorce system as well.
