作为一种社会性规制，职业许可是政府对公民职业选择自由进行的限制。其实施既需付出成本，同时也产生一定收益。因此，对职业许可进行成本与收益分析，有利于权衡职业许可的利弊得失。但是，收益大于成本仅是实施职业许可的必要条件，而非充要条件。按照法经济学理论，职业许--r~J正当性，还取决于职业许可的净收益对其替代性选择的净收益是否具有比较优势。

As a kind of social regulation, occupation licensing is the governmental limitation on occupational freedom of citizens. Its implementation needs to pay some of the cost,but also to have a certain income at the same time. Therefore, a cost-benefit analysis will benefit weighing the pros and cons of the occupation licensing. However, to produce more benefits than costs is the necessary not sufficient condition for occupation licensing. According to the theory of law and economics, the legitimacy of occupation licensing depends on whether the net benefit of occupation licensing has advantages compared to its alternatives.
