以司法确认“定西经验”为研究范本，以谱系合法性、实质合法性和经验合法性作为合法性范式典型分类，司法确认制度在权力来源、价值衡量、社会支持等方面均要接受合法性范式检视。在反思合法性范式自身局限性基础上，在防范“偏至思维”前提下，司法确认制度整体合法性范式考量的宽容立场得以生成，但对司法确认制度试验能动式扩展其调整范围需要持以审慎立场。司法确认制度合法性范式分析呈现动态特性，当“法律精英主义”干预与社会自治水平处于此消彼长之时，司法确认制度需要接受合法性范式的重新洗礼。
以司法確認“定西經驗”為研究範本，以譜繫閤法性、實質閤法性和經驗閤法性作為閤法性範式典型分類，司法確認製度在權力來源、價值衡量、社會支持等方麵均要接受閤法性範式檢視。在反思閤法性範式自身跼限性基礎上，在防範“偏至思維”前提下，司法確認製度整體閤法性範式攷量的寬容立場得以生成，但對司法確認製度試驗能動式擴展其調整範圍需要持以審慎立場。司法確認製度閤法性範式分析呈現動態特性，噹“法律精英主義”榦預與社會自治水平處于此消彼長之時，司法確認製度需要接受閤法性範式的重新洗禮。

The judicial reformation system＇spower origin, value weight and social support level by taking＂ Dingxi Expe rience＂as a research sample and regarding pedigree legitimacy, substantive legitimacy and empiricism legitimacy as typical legitimacy paradigm classification needs to be analyzed. On the basis of the reflection on the inherent limitations of legitima cy paradigm itself and the prevention of ＂extreme thinking＂, the tolerance stance as a whole to consider legitimacy para digm generated, but we must have prudent standpoint in expand its range of adjustment actively. As the legitimacy para digm has dynamic characteristic, the judicial reformation system need be reconsidered in legitimacy paradigm when the level of social autonomy transcend the interference of legal elitism.
