我国关于赦免制度只是在宪法、刑法和刑事诉讼法的相关条款中有零星规定，这种立法现状在法治日益健全的今天几乎注定了其被悬置的命运。完善我国的赦免制度，首先要从实体上丰富赦免的种类，包括大赦、特赦、赦免性减刑和复权四部分。其次要从程序上予以完备，以保证赦免制度的规范运行。在特别赦免中，死刑案件特别赦免程序值得专门研究。关于赦免的立法模式，就我国的实际情况看，制定一部专门的《赦免法》，明确赦免实施的各项实体和程序条件，比较科学可行。

The provisions concerning pardon system are separately prescribed in the related articles of the Constitutional Law, Criminal Law and Criminal Procedural Law in our country. In the era of increasing improvement of the rule of law, the pardon system is put into cold storage because of this kind of legislation. In terms of improvement of the pardon system, firstly, the substantive rules of pardon system should be perfected, especially enriching the types of pardon, including amnesty, pardon, remission of sentence, restitution of civil rights. Secondly, the procedural rules of pardon system should be designed in order to regulate the operation of this system. It should be noted that the capital cases deserve particular studies concerning the special pardon. As to the model of legislation, a specialized Pardon Law, which clearly codifies the substan- tive rules and procedural rules of pardon system, should be legislated in the light of the actual conditions in our country.
