网络技术的发展为广播节目传播拓宽了途径，有些国家版权法随之修改。我国《著作权法》中有关广播组织在网络空间的权利保护并未明确。因此，我国《著作权法》应当增加广播组织的网络转播权、网络同步播放权、录制后播送权、向公众提供已录制的广播节目权等权利，以期实现公平竞争的三网格局，并从公共利益平衡角度对此权利作出一定限制。

The development of network technology broadens the way for broadcasting program transmission, copyright law then modified in some countries, ＂WIPO protection treaty of the broadcasting organizations＂ draft also are discussed and put forward the alternative offer to extend the rights of broadcasting organizations to the cyberspace. However, the copyright protection of broadcasting organizations in cyberspace in our country＇s copyright law is not clear. The right of broadcasting organizations has not been really guaranteed. Through the definition of network broadcast, transmission mode and the international community＇ rule on his legal norms, this article concludes and analyze the different point of view, put forward that under the background of triple play, the copyright law in China should increase the network broadcasting rights, network synchronization broadcasting rights, recording broadcast rights, available recorded broadcast rights to the public and other rights to achieve the fair competition three network pattern, and make a certain limit to those rights from the perspective of public interest balance.
