由于对行政担保理论的认识存在误区，加之行政担保确实存在一定的现实风险，我国相关法律严格限制行政担保的范围。而现实行政活动中法律禁止的行政机关直接担保行为依然大量存在，当前社会经济发展和政府职能的转变又迫切需要发挥行政担保在公共行政中不可替代的作用，这反映出在行政担保方面现实需求与理论研究的脱节。因此有必要对行政担保的基础理论进行深入研究，以经济社会结构变迁为线索，运用行政行为理论分析模式对行政担保的概念、特征、分类方式予以界定，分析论证行政担保法律行为的理论和现实基础，构建与经济社会发展相适应的理论体系，为行政担保法律制度改革扫清理论障碍。

Because of the wrong understanding of the administrative guaranty theory and the risk existed in certain administrative guaranty, China＇s relevant laws strictly limit the scope of administrative guaranty. However, a lot of direct guaranty behaviors of the administra tive authority, which are prohibited by law, still exist in the reality. During the current so cial and economic development and the transformation of government functions, the admin istrative guaranty is urgently needed to play an irreplaceable role in the public administra tion, which reflects that the theory is disjoined to the practical demand in terms of adminis trative guaranty system. So it is necessary to conduct the thorough research into the basic theory of administrative guaranty, to construct the basic theoretical system that can meet the needs of economic and social development, and to clear away the theoretic barrier to its reform. Based on the clue of economic and social structure changes, using the analysis mod el of the theory of administrative behavior, the article defines the concept, characteristics, and classification way of administrative guaranty, analyzes its theory and realistic basis, re constructs its basic theory that can meet the needs of economic and social development, and bases on the prospects of basic path into reforming the Chinese administrative guaranty law.
