从人力市场归一化的分析来说,应当建立统一的劳动力市场。但在劳务派遣实践中,因为存在着劳务派遣工权利保护的障碍来自于系统性的用工歧视制度结构,劳务派遣立法过程中缺少充分的意见表达通道,致使劳务派遣中利益攸关的劳动者无法将自己的利益需求有效表达出来,劳务派遣实践中劳动者利益保护成本相对较高等原因,给劳务派遣工的权利带来了多重损害。应当通过构建平等的法律文化,建立有效的劳务派遣工参与机制和管理机制,完善并严格法律法规,把劳务派遣真正关进法制的笼子里,构建接近正义的法律适用体系,开展员工关怀、培育正常良性的雇佣关系,注重技能培训、提高企业的责任承担能力,发挥工会作用、保障民主权利等机制,才能真正实现人力市场的统一,为劳务派遣工提供平等的法律保护。
從人力市場歸一化的分析來說,應噹建立統一的勞動力市場。但在勞務派遣實踐中,因為存在著勞務派遣工權利保護的障礙來自于繫統性的用工歧視製度結構,勞務派遣立法過程中缺少充分的意見錶達通道,緻使勞務派遣中利益攸關的勞動者無法將自己的利益需求有效錶達齣來,勞務派遣實踐中勞動者利益保護成本相對較高等原因,給勞務派遣工的權利帶來瞭多重損害。應噹通過構建平等的法律文化,建立有效的勞務派遣工參與機製和管理機製,完善併嚴格法律法規,把勞務派遣真正關進法製的籠子裏,構建接近正義的法律適用體繫,開展員工關懷、培育正常良性的僱傭關繫,註重技能培訓、提高企業的責任承擔能力,髮揮工會作用、保障民主權利等機製,纔能真正實現人力市場的統一,為勞務派遣工提供平等的法律保護。

From the analysis of labor market normalization,we should establish a unified labor market. But in the practice of the labor dispatch, because there is a labor dispatch workers rights protection barriers from sys tematic structure of employment discrimination, labor dispatch legislation lacks sufficient opinion expression channels, in the process, the stakeholders in the labor dispatch workers cannot express their interests demand effectively,in the practice of labor dispatching, laborers interests protection cost is relatively higher, which brings multiple damage to the rights of labor dispatching work. So we should build equal legal culture, build ef fective labor dispatch workers participation mechanism and management mechanism, perfect and strict laws and regulations, put the labor dispatching really shut in the cage of the legal system and build a close to the appli cable law of justice system, carry out staff caring, cultivating normal and benign relationship of employment, pay attention to skill training, improve the ability of responsibility of enterprises, play a role of trade unions, protect the rights of democracy, such as mechanism, can we truly achieve the unification of the labor market, provide e qual protection of the laws of labor dispatching work.
