我国体育法治存在等同于体育法制、否定自治全盘法治化、照搬照抄国际经验等问题。从法哲学视野来看，体育法治浸润在社会主义法治国的宏观政治环境、自由而个性化的体育环境和理性的体育文化环境中，应当契合国家法治，选择以理性主义为主、自然演进为辅的混合型体育法治生长逻辑之路。

The existence of China＇ s rule of sports by law is identical with the ruling of sports by law, the negation of overall legalization of autonomy and the indiscriminate copy of international experiences. From the perspective of philosophy of law, sports rule of law is infiltrated in the macro political environment of socialist countries, free and personal- ized sports environment and rational sports culture environment, so it should agree with the national governess by law and choose the compound development path with rationalism as primary stream and natural evolution as supplementary means.
