民事案件调解的解决方式即是妥协艺术．这种妥协非当事人主动意思，而是一种被动式的妥协。运并不是对原则的牺牲，而是自我利益最佳判断者——当事人自由意志的表现，是正当程序价值的表征，其与恢复性司法存在异曲同工之处。对于如何引导当事人作出妥协，除了把握好当事人主张权利的正常心理外，其无恶意和恶意诉讼值得我们认真对待。调解法官应该努力改变当事人的参照点，充分利用和发挥妥协的积极价值，避免、化解妥协的消极影响，应寻求利益最大化的平衡，调动各方力量创造群体效应，增强亲和力营造人文氛围，保护妥协方利益，确保实现案结事了。

Civil cases mediation is art, the compromise of the initiative, hut rather a kind of passive compromise. Judges should try to change the reference of the parties, make lull use of and exert the positive value of compromise, avoid, eliminate the negative influence to compromise. We should do the following several work., to seek the balance of the ben efit maximization, to mobilize all forces to create the group effect, enhance the humanities atmosphere. At last. we should protect the interests of the party compromising, to ensure case knot.
