The theory of public domain is one of the core theories of copyright law. However, there is possibility that a theory goes to the opposite if it is inappropriately used. There are two typical misconceptions of public domain in the field of intellectual property. The mission of the theorists is to realize its essence, point out its disadvantages and shortcomings. Therefore, in order to avoid the misleading way, make it possible for people to use ＂public domain＂ theory in a right way and with a right standpoint and provide conditions to exercise the normal function of public domain theory, it is necessary to bring order out of chaos, figure out the wrong path of existing theory, explore its nature, and put forward the way of theoretical reconstruction.
