20世纪70年代以来,全球范围内兴起了一场规制改革运动.从行政法的视角回顾梳理东西方政府规制改革的不同样本,比较分析其中的共性规律和不同特点,探析规制改革背后深层次的理论依据,对于全面深化改革、加快政府职能转变和机构改革、推进国家治理体系和治理能力现代化具有很强的理论和实践价值.我国全面深化改革、推动政府简政放权,应该在有限政府与负面清单、法治思维与法制手段、权威机构与广泛参与、决策评估与激励手段方面有所借鉴.

Since the 1970s, the glob raised a regulatory reform movement. From the perspective of ad- ministrative law this paper reviews the different samples of the government regulation reform in the east and west, comparatively analyzes the common laws and different characteristics, and analyzes the theoretical basis deeply behind the regulatory reform,which has a strong theoretical and practical value, accelerate the change of government function and institutional reform, and promote the modernization of national management system and management ability. Comprehensively deepening reform in our country, and promoting the government decentralization should be in the limited government and negative listing, the rule of law thought and legal means, authority and broad participation, decision-making assessment and incentives.
