宪法规制紧急状态启动是维护宪法秩序、规制行政紧急权和保护公民基本权利的需要。紧急状态启动涉及的主要内容包括紧急状态的界定和分类、确定宣布紧急状态的主体和程序、限定紧急状态的期限。我国紧急状态启动制度存在紧急状态的界定不明确、宣布紧急状态的程序不具体和没有规定紧急状态的期限等问题。为完善紧急状态启动制度，我国宪法未来需要对进入紧急状态的条件、决定和宣布紧急状态的程序、紧急状态的持续期限和延期程序加以明确。

The constitutional regulation on the initiation of the states of emergency is indispensable for maintaining constitutional order, regulating the administrative emergency power and protecting citizen＇s fundamental rights. The initiation of the states of emergency includes the definition and classification of the states of emergency, the clarification of subject and procedure of declaration thereof and the limitation of the duration thereof. The unclear definition of states of emergency, the implicit procedure of declaration thereof and the lack of the duration thereof are main problems existing in China＇s legal system of the initiation of the states of emergency. To improve China＂ s legal system of the initiation of the states of emergency, the constitution need to make clear the conditions of the initiation of the states of emergency, the procedure of the determination and declaration thereof and extension procedure and duration thereof.
