中国劳动教养制度在维护社会稳定与社会秩序方面曾经起到过积极作用，但因其内在的固有缺陷对公民基本人权也造成一定的侵犯。随着法治中国建设的持续深入发展，劳动教养制度不仅与我国宪法法律的人权保障要求相背离，而且也与国际人权公约的规定相冲突，废止劳动教养制度并进行相应的制度改革，就成为我国法治建设与人权保障事业发展的必然要求。
中國勞動教養製度在維護社會穩定與社會秩序方麵曾經起到過積極作用，但因其內在的固有缺陷對公民基本人權也造成一定的侵犯。隨著法治中國建設的持續深入髮展，勞動教養製度不僅與我國憲法法律的人權保障要求相揹離，而且也與國際人權公約的規定相遲突，廢止勞動教養製度併進行相應的製度改革，就成為我國法治建設與人權保障事業髮展的必然要求。
중국노동교양제도재유호사회은정여사회질서방면증경기도과적겁작용，단인기내재적고유결함대공민기본인권야조성일정적침범。수착법치중국건설적지속심입발전，노동교양제도불부여아국헌법법률적인권보장요구상배리，이차야여국제인권공약적규정상충돌，폐지노동교양제도병진행상응적제도개혁，취성위아국법치건설여인권보장사업발전적필연요구。
China＇s reeducation through labor system has ever played a positive role in the maintenance of social stability and social order .But its inherent flaws have to some extent caused infringement of citizens＇basic human rights.With the development of the rule of law construction , the system of reeducation through labor not only devi-ates from human rights protection stipulated by the constitutional law , but also conflicts the provisions of the interna-tional convention on human rights .Therefore , it is essential to abolish the reeducation through labor system and re-form the system in the progress of legal construction and human rights protection in China .
