我国的法律方法论研究经过30年来的发展，取得了令人称道的成绩。但近两年的研究似乎进入了“瓶颈”制约期，法律方法论的主题话语似乎被法律修辞所取代，面向实践的法律方法研究更是极度缺乏，从而导致具有工具属性的法律方法不能为司法实践提供有力指导。结合当下中国的司法实践，探讨各种法律方法的实践应用，或许是法律方法论研究走出目前这种“瓶颈”制约的有效途径。
我國的法律方法論研究經過30年來的髮展，取得瞭令人稱道的成績。但近兩年的研究似乎進入瞭“瓶頸”製約期，法律方法論的主題話語似乎被法律脩辭所取代，麵嚮實踐的法律方法研究更是極度缺乏，從而導緻具有工具屬性的法律方法不能為司法實踐提供有力指導。結閤噹下中國的司法實踐，探討各種法律方法的實踐應用，或許是法律方法論研究走齣目前這種“瓶頸”製約的有效途徑。
아국적법률방법론연구경과30년래적발전，취득료령인칭도적성적。단근량년적연구사호진입료“병경”제약기，법률방법론적주제화어사호피법률수사소취대，면향실천적법률방법연구경시겁도결핍，종이도치구유공구속성적법률방법불능위사법실천제공유력지도。결합당하중국적사법실천，탐토각충법률방법적실천응용，혹허시법률방법론연구주출목전저충“병경”제약적유효도경。
With the development of the study of legal methodology in last two and three decades, the research content becomes richer achieves a commendable result. It seems that the legal methodology has been taken place by legal rhetoric and little research of the application of legal methodology has been done which resulted in less sufficient instruction of it. The study of application of legal method in legal practice would he hepful to find out problems and solve problems.
