The identification of the amount is a problem which must be solved in the study of intellectual property infringement and crime. The amount is the boundary of the difference in undertaking the legal liability. Moreover, the amount affects the identification of the crimes and the proper determination on the nature of the conduct and its measurement of penalty. There are four concepts in the crime against intellectual property rights, the amount of illegal business, the amount of illegal gains, the amount of sales and the amount of commodities. These four concepts have different function in the determination on the nature of the crime against intellectual property and its measurement of penalty, which required clarification in the legislative and judicial interpretation so they can be applied accurately in the judicial practice.
