印度最高法院关于格列卫案的判决吸引了国际社会的广泛关注，不仅关系到印度新修改的专利法对药品专利问题的态度，也影响了广大发展中国家低收入患者的药品可得性问题。印度作为公共健康问题较为严重的发展中国家，非常重视公共健康问题的解决，重视对本国制药企业的保护。该案判决为发展中国家解决公共健康问题提供了有益的借鉴，在TRIPs协议框架下，主权国家完全可以在公共健康问题的解决方面做得更多。

The judgement to the case of Glivec by the Supreme Court of India has aroused broad concern in international community. The judgement relates not only to the attitude of India＇s the new amended patent law towards patented pharmseutical products, but also affected medical availability of low income patients in developing countries. As a developing country with comparatively serious public health problems, India pay much attention to solving the problems, to protecting domestic pharmseutieal industry. This judgement provides good references for developing countries in adderessing intellectual property law and public health issues. Even under the TRIPs framework, states can do much more in solving the preoblems.
