2012年刑诉法的再修改,在酌定不起诉的基础上,又增设了附条件不起诉,进一步扩大了起诉裁量权的空间。但与此背反的是,在目前法治环境和制度结构下,起诉裁量存在着缺乏程序正当化构造、业绩考核不合理、起诉裁量基准不明确、不起诉替代性处置措施不足等病理,严重影响了起诉裁裁量权运行的合法性和有效性,诱发了检察机关基于组织理性严格控制起诉裁量权的行动逻辑;检察官基于个体理性懈怠行使起诉裁量权的策略行为,使起诉裁量权的“怠用”固化为可怕司法惯性。必须从增强起诉裁量权运行的合法性和有效性人手,构建起诉裁量的正当化程序,明确起诉裁量标准,充实不起诉替代性处置措施,增强社会公众理解认同、增加检察官中立性,进而改变检察组织和检察官的行动逻辑,实现起诉裁量权从价值回归到理性回归。
