马克思的分配正义不仅仅包含按劳分配与按需分配及其因地制宜的具体措施,更本质地刻画了分配不可逾越的历史现实。这就要求我们在哲学和实践上真实地面对马克思的分配正义。本文认为,与一般的仅仅在分配问题和权利问题上兜圈子的实证主义研究路径不同,马克思通过对人类生产实践尤其是对构成其基础的生产方式和生产关系的考察,构建了分配正义研究的双重人类性视野：劳动与需要。这是马克思在批判资本主义分配的基础上对分配正义的重构。

The justice of distribution in Marx not only contains distribution according to work or need and its concrete measures of local conditions,but also essentially describes an impassable historical reality of the distribution.We must factually be faced with the justice of distribution in Marx with the opinion of philosophy and practice.This paper insisted that Marx studied the mode of production and production relations which are the base of production practice,and constructed the humanity double vision of distributive Justice：labor and need.It＇s different from the positivism which is limited to the single distribution and right.That is Marx＇s reconstruction of Distributive Justice on the basis of his criticism to the capitalism distribution.
