＂毒驾＂问题日益严重,学界呼唤＂毒驾＂入刑的声音也越来越大。由于＂毒驾＂与＂醉驾＂有着某种程度的相似处,随着＂醉驾＂入刑的效果日益凸显,效仿＂醉驾＂给＂毒驾＂立法的建议似乎变得可行。然而,通过对西方主要发达国家尤其是美国的＂毒驾＂立法进程的研究显示,＂毒驾＂问题之复杂远超＂醉驾＂,立法理念、科学技术、现实需求等多重因素制约着＂毒驾＂问题的研究,也给立法带来了巨大的挑战。在毒品日趋泛滥的今天,给＂毒驾＂立法对于我国已经是迫在眉睫的问题了,适度借鉴国外成功经验,吸取失败教训,对我们顺利实现＂毒驾＂入刑,有效打击＂毒驾＂行为,遏制药物滥用绝对是大有裨益的。

With the increasingly severe situation of drugged-driving problem,the calling for incriminating such behavior is more and more loud. As the effect of criminalization of drunk driving has become increasingly prominent,the suggestion that the legislation of drugged-driving need follow the same way of legalizing drunk-driving seems plausible. However,according to the research on the legislative processes of drugged-driving in the western developed countries,especially in the U. S. A,drugged-driving is a problem much more complex than drunk-driving,for the limitations on the study of drugged-driving,such as legislative concept,scientific technology,realistic demands,etc.,which have brought huge challenges to the legislation. As drug problems are increasing its spread in current days,to legalize drugged driving has become an extremely urgent issue in our country. To moderately learn from the successful experiences of foreign countries and draw their failure lesson,is of great advantage for us to successfully criminalize drugged driving,effectively fight impaired driving conduct,and curb drug abuse.
