刑法不是一元的,除了国家刑法之外还存在着民间刑法。从＂活法＂观念中可以找到民间刑法的根基。民间刑法具有起源上的自发性、罪与非罪标准的伦理道德性、演变过程的潜移默化性、内容上的民族个性等特征。既然刑法是多元的,对国家刑法规范及其用语的解释应坚持多元刑法解释原理。唯有如此,才能正确理解刑法规范的真实含义。

Criminal law isn＇t unitary because there is folk criminal law besides national criminal law.We can find the foundation of folk criminal law from the concept of＂living law＂.Folk criminal law has many characteristics such as spontaneous in origin,ethical standards on crimes,subtle evolution and national personality in content.Owing to multiple criminal laws,clauses and languages in national criminal law should be explained according to the principles of multiple criminal laws.Only in this way,can we correctly understand the true meaning of criminal law,and know where to find the answers to difficult cases.
