日常人的法律认识是普通的社会公众在各自社会生活过程中基于片段的法律经验和个别性的法律体验而对法律现象所形成的认识。由于日常人存在着文化水平、生活背景、职业等差异,他们对法律的认识程度、认识水平也存在着结构上的差别,但与前两者比较,日常人的法律认识表现出经验主义、非理性、自发性等明显特点。日常人的法律态度、法律利用以及法律配合度与他们的法律认识密切关联,其法律认识方式、认知路径和认识对象决定了其法律意识,这对他们的法律行为选择将会产生直接影响。

Ordinary people＇s understanding of law is the general public understanding of phenomena of law,which is based on incomplete and personal law experience in the process of their own lives.Because there are individual distinctions in culture level,living background,professions and so on among ordinary people,they have constructional differences on understanding degree and level of law.But compared with the former two,their understanding of law reflects some obvious features such as empiricism,non-rationality,spontaneity and so on.Ordinary people＇s law attitude,law utilization and law adaptability have close relationship with their understandings of law,and the way,cognitive routine and object of their understanding of the law play a decisive role in their law realization,which will directly affects their choice of law behavior.
