随着中国法治进程的不断推进，法治评估活动不断兴起，法治评估指标体系的设计成为研究者关注的焦点，但鲜有学者对中国法治评估指标体系的价值基准作出探讨与解析。建立中国法治评估指标体系的价值基准的选择条件，需遵循“良法之治的价值向度”、“兼顾法治普遍性与特殊性”、“与规范维度之间的可转换关系”。结合中国自身法治语境的特征，法治评估指标体系的价值基准包括“法律至上”、“权力规制”、“法制健全”、“程序正当”、“民主与形式平等”、“权利保护”及“正义与合道德性”七项构成要素。法治评估指标体系的价值基准也具有开放性，可以接纳与吸收中国新的本土法治伦理价值。

With the further development of the rule of law in China, there emerges the activities of the evaluation of the rule of law, and many researchers are focused on the design of the index system of the rule of law evaluation. However, few researchers have made any discussions or investigations on the value foundation of index system design. This paper makes an argument for the necessity of constructing a reasonable, general and formal index system of the assessment of the rule of law, and proposes the selection requirements for the index system, namely, conforming with ＂the value dimension of the rule of good law＂, ＂combining of the generality and peculiarity of the rule of law＂, ＂the convertible relation with standards＂ . At last, in light of the characteristics of the context of Chinese rule of law, this paper comes up with seven constructive elements of the index system, including ＂the supremacy of law＂, ＂regulation of power＂, ＂sound legal system＂, ＂proper procedure＂, ＂democracy and formal equality＂, ＂right protection＂, ＂Justice and morality＂, and points out that the openness of the value base of the index system allows the integration with the rich Chinese local ethical values of the rule of law.
