自担风险、自负其责是为人处世的基本准则，权益保护与行为自由是侵权法努力平衡的两大目标。我国侵权法过于强调公平责任，导致行为人不担风险、加重赔偿责任、限制行为自由等弊端，需要加以校正，可供选择的路径之一，就是借鉴美国侵权法“行为人自担风险”规则。
自擔風險、自負其責是為人處世的基本準則，權益保護與行為自由是侵權法努力平衡的兩大目標。我國侵權法過于彊調公平責任，導緻行為人不擔風險、加重賠償責任、限製行為自由等弊耑，需要加以校正，可供選擇的路徑之一，就是藉鑒美國侵權法“行為人自擔風險”規則。
자담풍험、자부기책시위인처세적기본준칙，권익보호여행위자유시침권법노력평형적량대목표。아국침권법과우강조공평책임，도치행위인불담풍험、가중배상책임、한제행위자유등폐단，수요가이교정，가공선택적로경지일，취시차감미국침권법“행위인자담풍험”규칙。
At one＇s own risk and responsibility is mainly basic norm of human behavior. The protection of rights and the freedom of behavior are the two goals tort law tries to balance. Chinese tort law needs to be improved because it emphasizes too much on fair responsibility, which leads to behavior actor＇s taking no risks, increases the responsibility for compensation, and restricts freedom of behavior. One of the alternative path is to learn from American tort law rules -assumption of the risk rule.
