民族地区形成了独特的族源、语言、宗教和习惯等,国家法当进入这些特殊＂乡土社会＂之时,其与当地习惯法的冲突自然不可避免。在社会转型、价值多元的当代中国,如何实行避免脱离本土资源的＂法治＂是一个亟待研究的问题。本研究从法人类学角度出发,在对西北某一民族地区进行田野调查的基础之上,分析国家法与习惯法在民族地区的冲突,探讨西北民族地区多元化纠纷解决机制的建构。

Since minority region, a kind of rural society, owns special ethnic origin, language, religion and habit,the collision between nation law and customary law is inevitable. Facing the current pluralistic China in transformation, we must pay attention to the problem of not separating the government of laws from indigenous resources. Based on field survey of minority area in northwest region, the article will attempt to study the collision between nation law and customary law, constructing dispute resolution multi-mechanics in northwest minority region from the perspective of legal anthropology.
