In the case U. S. - Anti - dumping Methodologies （ China）, China put forward two ＂as such＂ claims and one ＂as applied＂ claim regarding Adverse Facts Available principle and its application. Although there exists some difficul- ties in proving the ＂as such＂ claim regarding the related legal instruments, it is still possible for China to persuade the panel to affirm it. In addition, China could provide sufficient evidence to support the ＂as such＂ claim regarding to the consistent practice of U. S. department of commerce in using AFA and the ＂as applied＂ claim regarding to the applica- tion of AFA in anti - dumping investigations involving 13 products. It is quite possible for the two claims to be affirmed by the panel.
