《关于完善人民陪审员制度的决定》颁布以来，人民陪审员制度在实践中发生了明显的职能异化和虚化现象，其原因是受到了部门利益的影响，亦即法院系统在该制度的立法和实施过程中谋求本部门工作的便利和利益，以致影响了人民陪审固有价值的实现。要想实现其司法民主、司法监督等预设价值，就必须将陪审还原为公民的宪法性权利，去除部门利益的影响，具体包括科学民主立法，深化司法体制改革，健全监督制约机制等。

The people＇s assessors system has been obviously dissimilatory and nominal since the incep-tion of Decision on Perfection of People’s Assessor.The reason for this is that the court system seized departmental interests in the establishment and implementation of the people＇s assessor system,so that the inherent value is difficult to realize.In order to realize the value of jury system functioning in judicial supervision and judicial democracy,the people＇s jury must be recovered to the constitutional right of citizen. We must restrict the departmental benefits,including scientific and democratic legislation,promoting the reform of the judicial system,and improving the system of supervision and restraint mechanisms.
