近代监禁刑的产生，取代了古代残酷的死刑、肉刑，这不能不说是人类文明的一大进步；围绕着监禁刑发展起来的一系列监禁制度已走过较长的历史时期，其与现代社会发展下社会理念的冲突也愈发明显。可以说，现代监禁制度在理性与进步的价值追求目标下，实现自身变革已刻不容缓，这也是现代刑罚理念和刑罚目的的客观要求。
近代鑑禁刑的產生，取代瞭古代殘酷的死刑、肉刑，這不能不說是人類文明的一大進步；圍繞著鑑禁刑髮展起來的一繫列鑑禁製度已走過較長的歷史時期，其與現代社會髮展下社會理唸的遲突也愈髮明顯。可以說，現代鑑禁製度在理性與進步的價值追求目標下，實現自身變革已刻不容緩，這也是現代刑罰理唸和刑罰目的的客觀要求。
근대감금형적산생，취대료고대잔혹적사형、육형，저불능불설시인류문명적일대진보；위요착감금형발전기래적일계렬감금제도이주과교장적역사시기，기여현대사회발전하사회이념적충돌야유발명현。가이설，현대감금제도재이성여진보적개치추구목표하，실현자신변혁이각불용완，저야시현대형벌이념화형벌목적적객관요구。
The replacement of ancient cruel death and corporal punishment with modern imprisonment has been a great progress of human civilization, and the prison system, concerning the punishment of imprisonment, has gone through a long history. How- ever, its conflict with modern social concepts is becoming more and more apparent with the development of society. Hence, it is urgent to reform modern prison system , which is in pursuit of the values of reason and progress. This is also the objective requirement of modern penal philosophy and purpose of punishment.
