关于碳关税在当前国际法上的依据和属性一直存在诸多争议，焦点集中在各国开征碳关税在经济上和国际法上的合理性问题。人类未来发展的道路必然是在可持续发展的前提下进行的，建立人类与环境、自然的和谐关系是人类社会重要的方向。因而，需要从全球气候治理全新角度对碳关税进行思考与定性，并思考中国未来的发展路经。
關于碳關稅在噹前國際法上的依據和屬性一直存在諸多爭議，焦點集中在各國開徵碳關稅在經濟上和國際法上的閤理性問題。人類未來髮展的道路必然是在可持續髮展的前提下進行的，建立人類與環境、自然的和諧關繫是人類社會重要的方嚮。因而，需要從全毬氣候治理全新角度對碳關稅進行思攷與定性，併思攷中國未來的髮展路經。

At present,there exist a good many disputes about the international law motivation and attributes of Carbon Tariff,whose focus is on the reasonability of the Carbon Tariff collecting in various countries economically and from the perspective of international law.From the author’s point of view,the future development of human-kind must depend on the condition of sustainable development,so establishing a harmonious relationship between human beings,the environment and nature is a significant tendency.Therefore,we need to consider and determine the Carbon Tariff from the perspective of global climate governance,as well as think about the future of China.
