死亡赔偿所得应当在明确各赔偿项目性质的基础上公平合理地在死者的近亲属之间予以分配。其中死亡赔偿金应当界定为对死者近亲属未来供养利益和身份利益丧失的赔偿，二者应分别根据受供养人的具体财产损失和近亲属与死者之间关系的亲密程度予以分配。对可以纳入死者遗产的赔偿金的分配则应当注意与《婚姻法》的衔接。至于基于赔偿协议的一揽子死亡赔偿款，原则上应当推定其包含了所有的法定赔偿项目并予以合理分配。而我国目前的死亡赔偿制度在赔偿请求权主体、死亡赔偿金的计算等方面也应予以相应的完善。

Damage tor wrongful death should be distributed fairly among the close relatives of the decedent on the basis of the nature of each element in the damages. Death damages should be defined as compensation tier the loss of future finan- cial loss and the loss of family relationships. The tormer should be distributed in accordance with the actual support loss of each dependent, and the latter should be distributed according to the relationship between the beneficiary and the decedent. The distribution of damages maybe regarded as the decedent＇s assets should be coordinated with Marriage Law of PRC. As far as the distribution of the lump sum settlement is concerned, it can be generally concluded that the sum includes each le- gal element of the damages. And it is very necessary to improve our current compensation system tor wrongful death.
