有关市场交易的近代业规一般涉及两大部分,一为同业价格约定,一为营业（交易）环节规范。晚清时期,上海地区工商会馆、行业公所最主要的职能是划一行业主打产品价格,制约同业价格竞争;有关其他营业方面的行业约定甚少。民国已降,随着市场竞争展开和业规细化,许多行业组织除了价格管理以外,对一些以往不甚措意的交易环节亦展开规范,制定了一些有关营业环节方面的规约以约束同业的经营行为。以往相关论著在论述近代同业公会等行业组织进行市场治理时,较多关注行业的价格管理及其违规制约;对于市场交易中其他方面的营业规约关注不多。本文以档案资料为凭,对于民国上海同业公会的有关营业规约作一简要阐述。

The modern industry regulations concerning market transactions usually involve two parts, one is the price agreement of the same industry, the other is norm of buying and selling. In late Qing Dynasty, the primary function of hall of industry and commerce was to standardize the prices of some main products, there were less industry conventions of other business areas. Since the establishment of the Republic of China, with the expansion of market competition and the refinement of industry regulations, many industry organizations developed some regulations concerning trade so as to restrict the business behavior of the same industry. This paper explores the business statute of guild in Shanghai during the period of the Republic of China.
