价值判断是刑法解释的核心问题，价值判断的主体性导致价值判断的复杂性，刑法中的价值判断由于其特殊性更加难以把握。但价值的客观性使刑法解释具有确定性，使罪刑法定原则具有实现的可能。受现代刑法价值理念和价值判断特性的双重制约，刑法解释应持客观解释论，解释过程应从正义观念、法条文义的最大可能范围和国民预测可能性三个维度进行，最后借助于程序正当性解决通过前述三个维度仍无定论的问题。
價值判斷是刑法解釋的覈心問題，價值判斷的主體性導緻價值判斷的複雜性，刑法中的價值判斷由于其特殊性更加難以把握。但價值的客觀性使刑法解釋具有確定性，使罪刑法定原則具有實現的可能。受現代刑法價值理唸和價值判斷特性的雙重製約，刑法解釋應持客觀解釋論，解釋過程應從正義觀唸、法條文義的最大可能範圍和國民預測可能性三箇維度進行，最後藉助于程序正噹性解決通過前述三箇維度仍無定論的問題。

Value judgment is the major issue in the interpretation of criminal law. Its complexity de-rives from its subjectivity. With its particularity, value judgment in the interpretation of criminal law be-comes even harder. Nevertheless, the objectivity of value leaves the interpretation of criminal law with certainty and principle of legality with possibility. Restricted by both modern criminal law and value judg-ment particularity, the interpretation of criminal law should be objective, with interpreting course from three dimensions, i.e., conception of justice, the largest extent of literal content of law, and the forecast for the possibility of nationals. Procedural legitimacy will be applied to those issues beyond those three di-mensions.
