从司法政策的角度，对当前我国知识产权司法保护的现实方位与发展方向进行了研究。结合国内外形势与我国知识产权司法保护历程和实际，分析了当前我国知识产权司法保护的阶段性特征和基本状况，重点提出了解决知识产权保护水平与知识产权状况不相适应、内外评价不一致等矛盾和问题。提出当前的知识产权司法保护态度应当理性成熟，深入阐述了正确处理其与国际经贸交往的关系、进一步增强知识产权保护制度认同感、构建体现我国创新发展利益诉求的话语权等问题。知识产权保护的基本政策态度应当是适度保护，主要体现在加强保护与营造创新发展空间的关系上。

This article studies on the reality orientation and direction of development of China＇s current judicial protection of intellectual property from the perspective of justice policy, analyzes the periodical characteristics and basic conditions of current judicial protection of intellectual property based on the domestic and international situation and history and practice of judicial protection of intellectual property, puts forward the solution to contradictions such as the maladjustment between protection level and condition of intellectual property and inconsistency between internal and external evaluation, suggests that current judicial protection attitude of intellectual property should be rational mature, elaborates several issues such as correctly dealing the relationship with international economic and trade exchanges, further enhancement of the identity of intellectual property protection system and construction of the right to speak which reflects innovation and development of China＇s interest demands. The basic attitude of intellectual property protection policy should be moderate, mainly in the relationship between strengthen protection and construction of space for innovation and development.
