基础性卫生立法需明确若干根本性问题，包括该法的价值取向、其在法律体系中的地位及自身体系的定位、所遵循的原则等。我国既有的碎片化单行卫生立法体制存在宏观上和微观上的各种弊端，因之需要进行基础性卫生立法，以期发挥协调、指引、整合作用并改变单行立法体制边际效益下降的困境。我国的基础性卫生法律体系可主要包括卫生母法和各卫生专门领域的基本法，卫生母法宜定名为“国民健康法”。卫生母法所确立的原则应具有宏观性、方向性、概括性和一般性；各卫生专门领域基本法的原则是母法原则的具体化和特殊化。

The fundamental health law＇s values, its status and legal systems, also the principles it abides by should be clarified. In light of the ills which derive from China＇s fragmented and dependent health legislative system, the fundamental health law must come into being to coordinate, guide and integrate the fragmented laws and to stem marginal effectiveness of legislation decline. could comprise the health parent law which The system of fundamental health law named “National Health Law” and the basic laws which domains different health sector. The principles established by the health parent law should be macro, directional, comprehensive and generic, otherwise the doctrines of the basic department health laws specify and specialize that of the parent law.
