商事仲裁制度是一种争议解决机制，为当事人在法院外解决纠纷提供了一种选择。一般来讲，商事仲裁可以分为临时仲裁（Ad hoc Arbitration）和机构仲裁（In．stitutional Arbitration）两种。临时仲裁作为世界普遍流行的商事仲裁制度，至今在我国难觅身影。随着中国（上海）自由贸易区的设立，临时仲裁的引入迎来新契机，有助于中国（上海）自由贸易区乃至我国商事仲裁制度的完善。

The commercial arbitration is one of the dispute resolutions, which provides parties an alternative dispute resolution instead of court lawsuit. Generally, commercial arbitration can be divided into the Ad hoe arbitration and the Institutional arbitration. The ad hoc arbitration cannot be admitted in China, although it is an internationally common dispute resolution. However, it is a great opportunity to establish the ad hoc arbitration in China （Shanghai） Pilot Free Trade Zone, which can improve the commercial arbitration in China （Shanghai） Pilot Free Trade Zone.
