法学理论通说将＂可能的字义＂作为法律解释与法律续造的界限。但是,自20世纪60年代以来,随着诠释学思想的影响,法诠释学理论逐渐发展起来。该理论对＂可能的字义＂界限理论进行了批判性的反思。以考夫曼及其学生哈斯默尔为代表,从根本上否认＂可能的字义＂作为解释的界限,并坚持将类型代替＂可能的字义＂作为解释的界限;以埃塞尔为代表,并不全面否定＂可能的字义＂作为解释的界限,只是对此提出质疑;以拉伦茨为代表,完全站在通说的立场,对＂可能的字义＂作为解释的界限持肯定态度。按照法治的基本精神,必须保留＂可能的字义＂理论作为法律解释的界限。

In accordance with the general theory of legal jurisprudence,the ＂possible literal meaning＂lays the boundary for legal interpretation and creation of new norms. However,since the 1960 s,the legal Hermeneutics has gradually developed under the influence of hermeneutic thoughts. The theory of legal Hermeneutics critically reflects on the boundary theory of＂possible literal meaning＂. Kaufman and his student Hassemer as representative,fundamentally denied that the ＂possible literal meaning＂can be considered as the boundary of interpretation. While Esser has challenged this theory rather than completely deny it and has neither abandoned such boundary theory. On the contrary,Larenz has completely asserted this theory and has shown a positive attitude. According to the basic spirit of ruling of law,it is proposed that the theory of ＂possible literal meaning＂should be held as the boundary for legal interpretation.
