我国《物权法》第24条“机动车为准不动产，以登记为公示方法，采登记对抗主义”的规定与机动车登记保护现状略有出入。机动车登记更为侧重于行政管理职能，与船舶航空器不同，因此应当将其划入一般动产行列，以占有为公示方法，辅之以登记情况排除善意，即可起到保护机动车物权的作用。
아국《물권법》제24조“궤동차위준불동산，이등기위공시방법，채등기대항주의”적규정여궤동차등기보호현상략유출입。궤동차등기경위측중우행정관리직능，여선박항공기불동，인차응당장기화입일반동산행렬，이점유위공시방법，보지이등기정황배제선의，즉가기도보호궤동차물권적작용。
According to the Article 24 of Property Law of the People＇ s Republic of China, ＂before registration, the creation, alteration, transfer or extinction of the property fight of the motor vehicles shall not be used against a bona fide third party＂, that provision is slightly different from the current situation of vehicle registration protec- tion. Vehicle registration pays more attention to vehicle administration, which is different from ship and aircraft. So the vehicle should be taken as movable property with possession for the publicity methods. Meantime, the parties can refer to the registration book to judge whether the third party is of bona fide. As a result, the consumers＇ fights will be well protected.
