金砖银行享有司法豁免权并不排斥对第三方权益的保障。国际组织争端解决实践表明，为第三方提供适当的救济路径有助于金砖银行司法豁免权获得非成员国的承认，从而降低涉诉风险。在现行国际法体制下，金砖银行对第三方承担的不是实体性的人权保护义务，而是程序性的救济路径保障。为此，我国可以推动金砖银行借鉴多边开发银行经验，建立监察机制，并明确我国法院对金砖银行的司法管辖和豁免标准。

The New Development Bank＇s immunity from jurisdiction does not exempt its pro- tection of the third parties＇ rights and interests. The practice of the resolution to disputes among international organizations shows that the provision of the third parties for sound remedy routes contributes to the recognition of the New Development Bank＇s immunity from jurisdiction by nonmembers and the reduction in litigation risk. Under current international legal system, the New Development Bank shall not incur substantive obligations to protect human rights, but pro- cedural obligation to provide ways to remedy. Therefore, China can advance the New Develop- ment Bank to learn from the multilateral banks and establish inspection mechanism, and define the jurisdiction and exemption criteria of the New Development Bank by our courts.
