生态文明制度建设是应对生态危机的重要保障。生态文明制度体系建设是一个系统工程,关键是要积极构建比较完善的自然资源法律保障体系。这就需要全面分析我国自然资源法律保护的制度现状,从中找出现有制度的差距和不足。自然资源的制度完善,需要建立健全从明确权利归属到规范开发利用再到违法行为法律责任承担的完整制度体系。具体而言,就是要用清晰的自然资源产权制度来落实自然资源权益的所有者,用自然资源用益物权制度来规范自然资源开发利用的行为,用自然资源法律责任制度来惩罚滥采乱伐等破坏自然资源的行为。

The construction of ecological civilization system is an important guarantee to dealing with ecological crisis. The construction of ecological civilization is a systematic engineering, the key of which is to actively build a relatively perfect legal protection system of natural resources. Therefore, a comprehensive analysis should be given to the current situation of the system of legal protection of natural resources in our country, and the gaps and deficiencies should be found out of this system. A series of steps are thus required in establishing and perfecting a complete system： the attribution of right should be definite; the development and utilization should be standardized and the corresponding legal responsibility should be undertaken for its illegal activities. To be specific, a clear property right system of natural resources should be carried out to guarantee rights and interests of the state as the owner of natural resources, and usufructuary right system of natural resources should be made to regulate the behavior of the development and utilization of natural resources, and legal liability system to natural resources should be built to punish those who destroy the natural resources by indiscriminate felling of trees, and the like.
