冒名处分他人不动产的行为既与无权处分不同也与无权代理有异,属于非典型案例。不动产冒名行为不符合不动产登记簿公信力的构成要件,因此不应适用《物权法》第106条或者类推适用该法第107条。为保护善意第三人的信赖,可以将不动产冒名行为类推适用于无权代理/表见代理制度,并透过被冒名者的可归责性与相对人信赖的合理性这两个要素的比较、权衡,在保障交易安全的同时,兼顾所有权人的利益。

Imposed disposal of real estate, different from unauthorized disposal and unauthorized agency, belongs to an atypical case. The behavior of imposture of real estate is not conformity with the constitutive element of the credibility of register book of real estate. Hence, article 106 of Property Law or analogy of article 107 cannot be applied. In order to protect the trust from a third party in good faith, the behavior of imposture of real estate can be applied for analogy of unauthorized agency or apparent agency. Through the comparison and balance between the accountability of the impersonated party and the rationality of trust from the counterpart, the interests of the owner shall be protected while guaranteeing the transaction safety.
