各司法辖区普遍将竞争中立作为制度建构的一项基本原则,但对其界定并不一致,这源于各自经济发展战略和制度环境的不同。基于我国改革开放的实际诉求,竞争中立制度承诺应被界定为：为发挥市场在资源配置中的决定性作用,政府最大限度地维护自由、公平竞争机制,确保所有企业面临相同的竞争环境所承诺的一揽子制度安排。在承诺的内容上,或者说在判断一项制度是否满足竞争中立的标准上,体现为政府商业模式合理化等八项要求。在兑现承诺的路径上,体现为通过竞争评估、竞争倡导促进所有法律、法规按照竞争中立的要求来制定与修改;通过竞争执法排除竞争中立制度障碍的影响;通过适用除外制度,弥补竞争中立制度的局限。

Fair competition and deregulation largely promote the economic development. Therefore,each country commonly takes institution construction as a basic principle. Base on the study of comparative law and our country＇s real appeal,competition neutrality institutional commitment should be defined as that： government,in order to realize the market decisive effect in resource allocation,to maintain free and fair competition assessment furthest,and to ensure enterprises facing the same competition environment,makes the institutional commitment. The institution content is embodied in eight requirement of government commercial pattern rationalization. The institution implementation is embodied in that： all laws and regulations,promoted by competition assessment and competition advocacy,are enacted and modified on the basis of competition neutrality,and package institution arrangement promotes administrative approval system and carries out negative list.
