对我国医疗过程中的促进死亡行为进行非犯罪化刑法应对,要格外注重死亡权之＂基本人权＂的性质所带来的深刻影响。对我国医疗过程中促进死亡行为进行非犯罪化处理,不宜采取法律明文规定的方式,而应当采取设置超法规的要素并交由司法者进行过滤式甄别的方式。理性考量日本对所涉行为具有阻却刑事违法事由抑或具有阻却刑事责任事由的具体争议,结合我国＂立法层面一律做犯罪化处理,而司法层面却部分做出罪化处理＂的实际情况,我国医疗过程中促进死亡行为的非犯罪化刑法应对,宜坚持＂以运用社会相当性理论阻却刑事违法为原则,以运用期待可能性理论阻却刑事责任为例外＂的立场。

The evaluation for the behavior of promoting death in medical process in Criminal Law at present should pay attention to the deep influence of the right for death which is the basic human right.It is not suitable to adopt explicit rule for the decriminalization of the behavior of promoting death in medical process at present.We shall look for extra-statute reasons which entitle the judiciary to examination and selection.The argument about the concrete causes to hinder the illegality or responsibility of the relevant behavior in Japan provides reference pattern.In China,the legislation criminalizes the behavior,while the judicial practice decriminalizes it partially.The decriminalization of the behavior of promoting death in medical process in China shall take the standard of ＂applying the social correspondence theory to hinder the illegality in ordinary circumstances while applying the anticipated possibility theory to hinder the criminal responsibility as an exception＂.
