当今社会是风险社会，法律实施的过程既是规制风险的过程也是风险产生的过程。党的十八大提出生态文明建设后，环境问题已经成为全国上下关注的重点问题。由于环境具有公共物品的属性，需要政府予以治理。在环境治理和环境执法的过程中，由于利益的多元化、环境行政权力的异化、环境执法人员的行政执法伦理的缺失、公众环境利益表达机制的不完善，必然会产生一定的风险。针对纠纷风险发生的原因，只有消除纠纷风险产生的根源，规范纠纷风险产生的过程，减少纠纷风险产生的因素，构建化解纠纷风险的途径才能有效防范环境执法纠纷风险。

Today＇s society is a risk society. The process of implementation of law is not only a process of regulation of risk, but also one of risk generation. Since the eighteenth Congress of the Communist Party of China put forward the construction of ecolog- ical civilization, environmental problems have become the focus attention of whole country. The environment has the features of public goods and need the government to govern. In the process of environmental management and environmental law enforce- ment, the emergence of disputes risk are unavoidable due to the diversification of benefits, alienation of environmental adminis- trative power, lack of ethics of the law enforcement officials and imperfect environmental public interest expression mechanism. To prevent disputes risk effectively during the environmental enforcement effectively, the following suggestions are put forward： eliminating the root causes of risks arising from the disputes, regulating the generating process, reducing the factors causing them and constructing ways to solve it.
