气候有益技术转让是应对气候变化的关键。自世界贸易组织成立以来,知识产权制度第一次在世界贸易体系下实现了统一——达成了WTO协议下的《与贸易有关的知识产权协议》(Trips)。促进技术转让是国际知识产权制度的重要目标之一,各国均应调整其国内知识产权立法以符合这样的目标。然而,各国立法之具体设计并不可能超越国家利益而统一于促进自身核心技术的跨国转移。这导致了气候有益技术Know-how至今难以向发展中国家有效转让。在全球共同应对气候变化的背景下,结合气候有益技术Know-how转让之现实困境,重新审视了主要技术输出国美国和主要技术进口国中国的专利和商业秘密立法。我国作为主要的发展中国家,应从促进我国气候有益技术获取和发展以及全球共同应对气候变化的利益角度,吸取美国立法与实践中的经验和教训,并着手调整国内立法和外交策略。

The transfer of climate- friendly technology is the key to tackling climate changes. Since the establishment of the World Trade Organization, a unified intellectual property system has been achieved within the world trading system. To promote the transfer of technology is one of the important objectives of the international intellectual property system. All nations should adjust their national intellectual property legislation to comply with the objectives; however, the national legislation agenda can never transcend national interests in order to promote international transfers of core technologies. This results in the inability of the efficient transfer of climate-friendly technology Know-how to developing countries. In the context of a globalized effort to cope with climate changes and with reference to the realistic obstructions faced by the transfer of climate- friendly technology Know- how, this paper re- examines the patent and trade secret laws practiced both in the US as the main exporter and China as the main importer of core technologies. As a major developing country, China should commit to the acquisition and development of climate- friendly technologies as one part of a globalized effort to cope with climate changes, draw on the experience and lessons of US in legislation and its implementation, and proceed to moderate domestic legislation and diplomatic policies.
